All content on this site — including but not limited to its source code, user interface design, layout, color scheme, typography, street-naming convention, merchant-onboarding flow, 3-D mall visualization, Virtual Walter AI assistant, QR-scan capture system, Mall Pass loyalty program, Bulletin Board features, advertising framework, textual copy, images, graphics, audio, and video — is the exclusive property of Waterfall Mall and its licensors and is protected by United States and international copyright law (17 U.S.C. § 101 et seq.), trade dress law, and other applicable intellectual-property statutes.

You may not use any portion of this site — including its visual design, feature set, business logic, copy, layout, or user experience — as source material, training data, or prompt input for any artificial intelligence, machine-learning, or generative system for the purpose of creating a substantially similar platform, marketplace, application, or derivative work.

Specifically, the following acts are prohibited without our prior written consent:

• Scraping, copying, or otherwise extracting the site’s design, code, copy, or structure to construct or refine an AI prompt.
• Using screenshots, page recordings, or code inspection of this site as input to an AI model (including but not limited to large language models, image-generation models, or code-generation tools) to replicate or substantially reproduce the site’s appearance, functionality, or concept.
• Sharing, publishing, or distributing prompt templates or instructions derived from this site that enable others to generate substantially similar works using AI tools.
• Building a competing marketplace that replicates the unique combination of features embodied in Waterfall Mall — including its community-focused street directory, avatar-guided onboarding, QR-scan lead-capture system, live 3-D shopper map, and Black history-named street taxonomy — whether or not AI assistance is used.

This prohibition applies to all visitors, registered merchants, advertisers, contractors, and any third party who accesses the site. Violation may give rise to claims for copyright infringement, misappropriation of trade dress, and unfair competition, and we reserve all legal remedies including injunctive relief and statutory damages.

“Waterfall Mall,” “Your Wall Street,” “Virtual Walter,” “Mall Pass,” and associated logos are trademarks or service marks of Waterfall Mall. The overall look and feel of this site — including its primary color palette, gold-accent design language, street-naming convention, and 3-D mall visualization style — constitutes protected trade dress. You may not use any of these marks or trade dress elements without our prior written permission.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the site solely for its intended purpose: shopping, browsing merchants, attending events, and, for approved merchants and advertisers, operating your storefront through our platform.

Fair use of short quotations for news commentary, criticism, or educational purposes remains permitted under applicable law. Any other use requires our express written consent.

If you believe that content on this site infringes your copyright, please send a written notice to [email protected] with (a) a description of the copyrighted work, (b) the specific URL of the allegedly infringing material, (c) your contact information, and (d) a statement of good-faith belief and accuracy, signed under penalty of perjury. Conversely, if you believe your content was wrongly removed, you may submit a counter-notice to the same address.

Merchants and users retain ownership of original content they upload (product descriptions, images, logos). By uploading content you grant Waterfall Mall a worldwide, royalty-free license to display and promote that content on the platform. You represent that your content does not infringe any third party’s intellectual-property rights.

The site is provided “as is.” We make no warranties, express or implied, regarding availability, accuracy, or fitness for a particular purpose. To the maximum extent permitted by law, our aggregate liability for any claim arising out of these Terms shall not exceed the greater of $100 or the fees you paid to us in the preceding 12 months.

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict- of-law principles. Any dispute shall be resolved exclusively in the state or federal courts located in Fulton County, Georgia.

We may update these Terms at any time. Continued use of the site after changes are posted constitutes acceptance of the revised Terms. Material changes will be highlighted at the top of this page.
